Which rules of exemptions are effective for stage 2 of the environmental zone from 1.1.2010?

On the 1.1.2010 stage 2 of the environmental zone became effective in Berlin. This means that only the vehicles of pollutant group 4 (green sticker) will be allowed to drive in the environmental zone. Vehicles with a red or yellow sticker will be affected by the driving ban in the same way as vehicles from pollutant group 1 are affected by the current driving ban in stage 1.

What applies to Euro 3 vehicles with a yellow sticker that cannot be retrofitted?

Euro 3 vehicles that cannot be retrofitted due to the unavailability of a particulate filter may drive with a yellow sticker in the environmental zone provided they display a certificate issued by a technical inspection centre confirming that retrofitting is not possible. However, a green sticker cannot be issued in such cases.
Euro 3 coaches and Euro 3 foreign-registered diesel vehicles may drive in the environmental zone with a yellow sticker until 31 December 2011 without having to provide such certification.

The special arrangements for coaches will not be extended. From 1 January 2012 Euro 3 coaches have to retrofit a filter or need a certificate from TÜV or DEKRA that this is not technically possible. For foreign vehicles, the exception will be extended beyond 2011.

The technical inspection centres of Dekra and TÜV in Berlin issue a temporary certificate. It can be renewed provided that retrofitting is still not possible for the vehicle.

Special cases: The filter in the database does not fit my truck - what should I do?

It sometimes occurs that a filter found by a technical inspection agency in the its database cannot be fitted to a truck for special reasons associated with the individual truck or because the truck is used for special purposes. In such cases the technical inspection agency can also issue a certificate confirming that the vehicle cannot be retrofitted provided relevant confirmation from the filter manufacturer is presented.
This confirmation must be submitted on the following form, which was drawn up with the filter manufacturers. You can obtain the form from workshops that perform retrofitting, from the technical inspection centres or the filter manufacturers, or you download it here:

When can a certificate of exemption for stage 2 of the environmental zone be applied for?

Applications for individual exemptions can only be filed from October 2009 with the traffic authorities of the districts located within the environmental zone. These are the following districts:

Which documents do I need to present for individual exemptions for the stage 2?

The correct application forms must be used for stage 2 applications. These will be available from mid-September from the appropriate district offices or can be downloaded here:
Different documents need to be presented - if necessary as legible photocopies - depending on the grounds for the certificate of exemption, in order to comply with the requirements for an exemption. Information sheets for the application forms contain further details.
The vehicle registration document (part 1) ("Fahrzeugschein") will be required in all cases.
In cases where the reason for exemption is the fact that retrofitting is not possible, the certificate must be issued by a technical inspection centre for motor vehicles. This is issued by Dekra and TÜV in Berlin, by TÜV in the states of former West Germany and by DEKRA in the new federal states.
CAUTION: Certificates issued by car repair workshops or by vehicle manufacturers stating that retrofitting is not possible will no longer be recognised.

What are the fees incurred for individual exemption?

The fees are based upon the administrative expenses and commercial benefit. Commercial benefit arises from the fact that, for example, no retrofitting needs to be done or that a replacement purchase must occur at a later date. This means that the fee depends on the type of vehicle, on the type of use (private or commercial) and on the duration of the certificate of exemption.
